pollution certificate for factory Video

In India, a "pollution certificate" for a factory is officially known as Consent, issued by the respective State Pollution Control Board (SPCB). It is a mandatory legal requirement under the Water Act, 1974  and the Air Act, 1981  to ensure your operations don't harm the environment.

1. Two Stages of Consent

You typically need two separate approvals depending on the stage of your project:

Consent to Establish (CTE): Obtained before you start construction or install any machinery. It's the primary "No Objection Certificate" (NOC).

Consent to Operate (CTO): Obtained after construction is complete but before starting actual production. This verifies that your pollution control systems (like ETPs) are working correctly.

2. Industrial Categories

Factories are categorized based on their Pollution Index (PI) score (0 to 100). Higher scores mean stricter regulations:

Red (PI > 60): Highly polluting; subject to the most stringent rules and frequent monitoring.

Orange (PI 41–59): Moderately polluting.

Green (PI 21–40): Low polluting.

White (PI 0–20): Non-polluting; generally exempt from CTE/CTO but may require simple registration or a self-declaration.

3. Application Process (Online)

Most states use the Online Consent Management & Monitoring System (OCMMS).

Register: Create an account on your state’s SPCB portal (e.g., DPCC for Delhi or UPPCB for Uttar Pradesh ).

Fill Application: Provide details about raw materials, manufacturing processes, water consumption, and waste generation.

Upload Documents: Common requirements include:

·         Site Plan and unit layout.

·         Detailed Project Report (DPR).

·         Investment Proof (CA certificate).

·         Land Ownership (Sale/Lease Deed).

·         Pay Fees: The fee depends on your capital investment and industry category.

·         Inspection: An official may visit your site to verify compliance before the final certificate is issued.
